USER CONTRACT

By accepting and viewing Surfaway Internet Services, Inc. (Surfaway), Web site (the "Site"), the User hereby agrees to be legally bound by the terms and conditions set forth below. The laws of the State of California shall govern any and all claims or legal issues relating to the Site or its use.

If any term or condition is deemed to be unenforceable for any reason whatsoever, it shall not effect the enforceability of any other term or condition contained herein. Surfaway is free to revise these terms and conditions at any time without notice.

Such revisions are binding and therefore, it is the responsibility of the User to periodically consult this page to become aware of any revisions.

USE RESTRICTION

The registered and unregistered trademarks, logos, images, copyrighted material and other intellectual property contained in the Site are the intellectual property of Surfaway, and others under contract with Surfaway. Except as provided below, no material from the Site, including without limitation, and trademark or logos, may be copied, reproduced, uploaded, downloaded, posted or republished without the prior written consent of Surfaway. Users may download one copy of material from the Site for their personal, informational, non-commercial use, on the condition that (i) User does not modify the material in any way, retaining all trademark and copyrighted notices; (ii) User maintains the material on a single computer; and (iii) User does not link the material to any other network computer or broadcast the materials in any other media.

TO THE FULLEST EXTEND ALLOWED BY LAW, Surfaway HEREBY DISCLAIMS ALL WARRANTIES. ALL MATERIAL ON THIS SITE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Surfaway DOES NOT WARRANT THE FUNCTIONALITY OF THE SITE OR THAT ANY ASPECT OF THE SITE OR ITS USE IS ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE OR ITS SERVER ARE VIRUS FREE OR LACK OTHER HARMFUL COMPONENTS. USERS ALONE ASSUME THE RISK AND ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION DUE TO ACCESS TO OR USE OF THE SITE. USER SUBMISSIONS

Surfaway is continually striving to develop or find the best products and services to provide to its customers and users of the Site. To avoid any misunderstandings stemming from products and services submitted from outside the company which are potentially similar to products that currently are in development or may be developed in the future by Surfaway, all potential external product or service submissions must be approved prior to submission by calling our Product Review and Development Department at (408) 247-9612. Under no circumstance should Users submit product or service ideas through the Site.

Any communications to the Site, including without limitation, product or services ideas. Suggestions, comments, concepts, questions, materials (collectively the "Submissions") shall upon transmission to the Site become the exclusive property of Surfaway. Surfaway shall have the worldwide exclusive right to use such Submissions in any manner it deems appropriate, including commercial purposes, without any obligation or compensation to the person or entity that made the Submission.

LINKS TO OTHER SITES

Surfaway has not reviewed all of the sites linked to the Site and does not endorse the accuracy or reliability of any of the content of such sites. Surfaway disclaims all responsibility for any of the content of the linked sites or User's access to or browsing of such sites which is at User's sole risk.
